Terms & Conditions

Welcome to The Booth Guy. By requesting a quotation, paying a retainer fee, or booking any of our services, you acknowledge that you have read, understood, and agree to the following Terms & Conditions. These terms are designed to ensure a smooth, enjoyable experience while protecting both our clients and our business.

1. Booking Confirmation

A booking is only confirmed once a 50% non-refundable retainer fee has been received.

Quotations are provided based on availability at the time they are issued. We do not reserve or hold event dates without a retainer fee. If no payment has been received, we reserve the right to accept another booking for the same date on a first come, first served basis.

2. Payments

• A 50% non-refundable retainer fee is required to secure your booking.

• The remaining balance must be paid no later than one (1) month prior to your event date.

• Failure to settle the outstanding balance by the due date may result in the cancellation of your booking without refund of the retainer fee.

3. Cancellation & Refund Policy

The retainer fee is non-refundable under all circumstances, including cancellations by the client.

Should you need to postpone your event, we may, at our sole discretion, transfer your booking to a new date, subject to availability.

Any payments made beyond the retainer fee will only be refunded if The Booth Guy is unable to fulfil the booking due to circumstances not within our control.

4. Event Setup

Our team will typically arrive approximately one hour before the agreed operating time to complete setup.

The client is responsible for ensuring that:

• The setup area is flat, clean and dry.

• Adequate space and power are available where required.

• The venue is accessible at the agreed setup time.

Delays caused by the client, venue, or other suppliers do not extend the booked operating time unless otherwise agreed in writing.

5. Equipment Care & Damage

Our equipment is professionally maintained and handled with care. The client accepts responsibility for ensuring that guests use the equipment appropriately.

Should any guest cause damage to our:

• Photobooth

• 360 Video Booth

• Cameras

• Printers

• Lighting

• Props

• Backdrops

• Tablets or accessories

through negligence, misuse, vandalism, or intentional damage, the client will be held financially responsible for the repair or replacement costs and will be invoiced accordingly.

6. Guest Conduct

Guests are expected to follow all instructions provided by our booth operator.

The Booth Guy reserves the right to temporarily suspend or stop operation of the booth if guests are:

• Intoxicated to the point of creating a safety risk;

• Acting aggressively;

• Misusing or attempting to damage equipment; or

• Creating an unsafe environment for our staff or other guests.

No refunds or additional operating time will be provided if service is interrupted due to guest behaviour.

7. Liability

The Booth Guy cannot be held liable for:

• Injuries sustained through misuse of the equipment.

• Damage to guests' personal belongings.

• Accidents caused by guests failing to follow operator instructions.

• Losses resulting from unsafe venue conditions outside of our control.

Guests use the equipment at their own risk.

8. Marketing & Media

Unless otherwise requested in writing before the event, The Booth Guy may use photographs and videos captured during your event for marketing and promotional purposes, including:

• Social media

• Our website

• Printed marketing material

• Advertisements

If you would prefer your event media to remain private, simply let us know before your event and we will gladly respect your request.

9. Privacy

Any personal information collected during the booking process will only be used for:

• Booking administration;

• Communication regarding your event; and

• Future promotions where consent has been given.

We will never sell or share your personal information with third parties without your permission unless required by law.

10. Force Majeure

The Booth Guy shall not be liable for delays, interruptions, or inability to perform due to circumstances beyond our reasonable control, including but not limited to:

• Severe weather

• Natural disasters

• Government restrictions

• Power failures

• Venue closures

• Civil unrest

• Acts of God

Where possible, we will work with you to reschedule your booking.

11. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the jurisdiction of the South African courts.

12. General

While we take every reasonable step to ensure your event runs smoothly, unforeseen technical issues may occasionally occur. Should this happen, we will make every reasonable effort to rectify the issue as quickly as possible or provide an appropriate solution.

By paying your retainer fee and confirming your booking, you acknowledge that you have read and accepted these Terms & Conditions.
